Terms and Conditions

The Terms and Conditions presented here apply to all purchases and sales of items offered here, and your purchase means you have accepted our Terms and Conditions of Sale. We disclaim any other Terms and Conditions contained in any customer purchase order, order form or otherwise unless expressly agreed by us in writing.

Warranties:

  SPI Brand. SPI brand products shall be free from defects in material and workmanship for a period of one (1) year from the date of shipment. Parts found to be defective in material and workmanship by SPI during the warranty period shall be replaced or repaired at SPI's sole discretion, as the exclusive remedies. Products found by SPI to be misused, abused or neglected are not covered under this warranty. Parts not covered by this warranty are normal wear or consumable parts such as (but not limited to) belts, filters, greases and lubricants, batteries, lamps, brakes and blades. This warranty is exclusive and in lieu of any and all other warranties whether written, oral, expressed or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose or non-infringement, including those instances where changes, alterations or modifications are made in materials at the request or instruction of the purchaser. In no event shall SPI be liable for any incidental, special, indirect, punitive, lost profits or consequential damages of any nature.

  Other Brands. Except as provided above, the only warranties applying to materials sold are those, if any, specifically provided by the manufacturer to be honored by the manufacturer. Items marked Lifetime Warranty are subject to manufacturer's warranty terms. As sellers, SPI makes no warranties, expressed or implied, of performance, merchantability, workmanship, quality, durability, suitability or non-infringement, including those instances where changes, alterations, or modifications are made in materials at the request or instruction of the purchaser. SPI's obligation is limited only to the repair or replacement of defective parts or, at SPI's sole discretion, to the refund of the purchase price. This warranty is exclusive and in lieu of any and all other warranties whether written, oral, expressed or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose. In no event shall SPI be liable for any incidental, special, indirect, punitive, lost profits or consequential damages of any nature. A full refund will be given to our customer, subject to our QA inspection, for any defective items returned to us and received by us within 30 days of the date of shipment in its original packaging.

Dangerous Goods/Hazardous Materials:  SPI prepares and ships hazardous materials in accordance with the requirements of the U.S. Department of Transportation (DOT) as contained in Title 49 of the Code of Federal Regulations (CFR) and individual carrier requirements. DOT regulations require us to provide special packaging for some products which may be considered to be potentially hazardous and which are excluded from air, UPS collect, and consignee shipments. You may receive a separate package, packing slip, and invoice for such items. Products such as these are generally identified by the "DOT Regulated" and "NO AEROSOLS" icons in our catalog. These regulations and the carrier requirements may be amended or changed from time to time. All hazardous materials require special handling and packaging. Carrier surcharges may apply and will be passed along to you. Please contact your dealer's customer service department for details.

Material Safety Data Sheet (MSDS):  A document required by the Occupational Safety and Health Administration (OSHA) providing specific Safety, Health and Environmental information about a product deemed to be hazardous (e.g. Hazardous Ingredients, Physical Hazards, Health Hazards, Safe Handling, Control Measures and more).
Manufacturers or importers are required to produce MSDSs and employers are required to have them available for their staff as per OSHA's Hazard Communication Standard 29 CFR 1910. 1200.
SPI provides Material Safety Data Sheets to its authorized dealers when required. You should receive a MSDS from your dealer when: You order the product for the first time, you reorder a product and an updated MSDS has been received from the manufacturer/importer since the last time you ordered the product, or you request another MSDS. SPI expressly relies on the evaluations of the chemical manufacturer/importer therein.

California Proposition 65:  Some products contain chemicals and, therefore, may be subject to warning requirements of California Proposition 65. Proposition 65 requires certain chemicals identified by the State of California as causing birth defects or other reproductive harm or cancer to require written warnings on SPI packing slips.

VOC (Volatile Organic Compounds) Limits:  SPI may be prohibited from offering certain products due to restrictions or requirements of various federal, state, local and other authorities having jurisdiction in these matters. VOC restrictions may change without notice. If this occurs, your dealer's customer service representative will notify you at order time.

MERCURY CONTAINING PRODUCTS:  Some products may contain mercury and may, therefore, be subject to federal, state, or local regulations regarding their purchase, use, handling and/or disposal. Purchasers should consult the regulations applicable to their operations regarding these products.

Export Controls:  The products sold by SPI are subject to U.S. export control and sanctions regulations. Any export or re-export contrary to U.S. law is strictly prohibited.

Responsibilty:  The value of the defective product or material is our only liability. All technical data has been supplied by the manufacturer and is listed only as a convenience. We do not warrant or represent that the merchandise complies with the provisions of any law, particularly the Walsh-Healey Public Contracts Act, and the Occupational Safety and Health Act of 1970, and regulations promulgated thereunder, unless the manufacturer so warrants.

Catalog Errors:  Although all information displayed on our web site and in our printed catalogs/flyers has been carefully checked for accuracy, errors and omissions occasionally occur and therefore are subject to correction. We regret any inconvenience.

Compliance with Laws:  Some localities may have Codes, Regulations and Laws governing sales, installations, use or construction of items for certain purposes which may vary from place to place. SPI does not guarantee compliance and assumes no responsibility for how the items are used or installed. The customer has the sole responsibility for compliance with all applicable Codes, Regulations and Laws. This includes, but is not limited to, CSA, FAA, DOT, NEC, UL, NOM, IATA, IMDG, CE, DIN, and ANSL, concerning the use or installation of items.

Security:  The swissprec.com web site uses a 128-bit SSL (secure socket layer) for the encryption of all sales transactions. It encrypts all of your personal information, including name and address so that it cannot be deciphered by anyone except SPI. All sensitive information remains on our server and will never be transmitted to anyone else for any reason.

These policies supersede all previous policies. SPI reserves the right to change prices, design, description, graphical representations, and discontinue products at any time and without prior notice.
